Agreement to Terms

By accessing and using Proximity's mobile application and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our proximity-based social messaging app.

Important: Proximity is currently in Beta testing phase. By using the Beta version, you acknowledge that the app may contain bugs, incomplete features, or other issues. Your participation in the Beta helps us improve the service.

Description of Service

Proximity is a proximity-based social messaging application currently in Beta testing that enables users to discover and connect with nearby people. Our service facilitates real-time messaging, location-based discovery, and social interactions within customizable proximity zones. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, especially during the Beta phase as we continue development.

Beta Testing Terms

By participating in the Proximity Beta, you acknowledge and agree that:

• The app is in development and may contain bugs, errors, or incomplete features
• Features may be added, removed, or significantly changed without notice
• Data loss or corruption may occur, and we recommend not relying solely on the app for critical communications
• You may be asked to provide feedback, bug reports, or participate in user research
• Your usage data may be analyzed to improve the app's functionality and user experience
• The Beta service may be discontinued at any time
• No warranty or guarantee is provided for Beta functionality

User Responsibilities

As a user of Proximity, you agree to:

• Provide accurate profile information and maintain truthful representation
• Use our services respectfully and in compliance with applicable laws
• Respect other users' privacy, boundaries, and safety
• Not engage in harassment, stalking, or inappropriate behavior
• Not share false location information or attempt to deceive other users
• Not use the app for commercial solicitation or spam
• Report any suspicious or unsafe behavior to our moderation team
• Maintain the confidentiality of your account credentials

Safety and Community Guidelines

Proximity is designed to foster meaningful, safe connections. Users must adhere to our community guidelines:

• Treat all users with respect and kindness
• Meet in public places for initial in-person meetings
• Trust your instincts and prioritize your safety
• Report inappropriate behavior immediately
• Do not share personal information (address, phone) until you feel comfortable
• Use privacy controls (Ghost Mode, Safe Zones) as needed

Location Services and Privacy

By using Proximity, you consent to location tracking necessary for proximity-based matching. You maintain control through privacy settings including Ghost Mode and Safe Zones. Location data is used solely for app functionality and is not shared with third parties.

Phone Number Verification via SMS

Secure Account Authentication

During account setup, Proximity uses SMS to verify your phone number through a one-time passcode (OTP). This step ensures that your identity is securely authenticated before accessing proximity-based features.

• Your privacy is protected: Your phone number is used exclusively for verification and never displayed to other users.
• App-first communication: All messaging between users takes place securely within the app—SMS is never used for chat or user-to-user contact.
• Device-level control: Verification is required once during setup. You maintain full control over your interactions within the app environment.

This process helps ensure a secure and trusted network while keeping all social interactions private and app-based.

Intellectual Property

All content, features, and functionality of Proximity are owned by Proximity and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Service Availability

While we strive to maintain high availability, we do not guarantee that Proximity will be uninterrupted or error-free, especially during Beta testing. Real-time features depend on network connectivity and device capabilities. We may perform maintenance that temporarily affects service availability. Beta users should expect occasional downtime, service interruptions, and potential data inconsistencies as we improve the platform.

Payment Terms

Proximity may offer premium features or subscriptions in the future. Payment terms will be clearly specified at the time of purchase. All fees are non-refundable unless otherwise required by law.

Limitation of Liability

To the fullest extent permitted by law, Proximity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Users acknowledge that in-person meetings arranged through the app are at their own risk, and Proximity is not responsible for offline interactions between users.

Indemnification

You agree to indemnify and hold harmless Proximity from any claims, damages, or expenses arising from your use of the app, violation of these terms, or any interactions with other users whether online or offline.

Termination

We may terminate or suspend your access to Proximity immediately, without prior notice, for any reason including breach of these Terms of Service, violation of community guidelines, or behavior that threatens user safety.

Governing Law

These Terms of Service are governed by and construed in accordance with applicable laws. Any disputes will be resolved through binding arbitration.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified terms.
